The Australian Competition And Consumer Commission Investigates Sony

Yes, you read that title right. The Australian Competition & Consumer Commission or the ACCC has filed proceedings in the Australian Federal Court to investigate Sony for “false and misleading information”.

This is all in relation to Sony’s refund policy. Digital purchases won’t be refunded after 14 days of purchase. And if you know Australia, you know they do not like that. Under Australian Consumer Law, a customer is actually allowed to receive any time after the purchase date for faulty products.

According to ACCC Chairman, Rod Sims:

Consumer guarantees do not expire after a digital product has been downloaded as we allege Sony Europe told consumers, and refunds must be given in the form of original payment unless a consumer chooses to receive it in store credit . . . Sony Europe’s alleged conduct may have caused Australian consumers to not seek a refund, replacement, or repair for a faulty game when the Australian Consumer Law gave them a right to do so.

Under Australian Consumer Law, if you operate and sell goods and services in Australia, you must abide by these guidelines. It’s very unlikely Sony will pull out of the Australian Market. Instead, they will probably update their refund policy for Australians, like Steam did when it was caught in the same issue.
